Executive Summary

The EU AI Act and GDPR are not competing frameworks — they are cumulative obligations. For HR departments deploying AI monitoring tools, this means two separate compliance tracks must run simultaneously and remain synchronized. A DPIA is mandatory under GDPR before deploying any high-risk AI monitoring system. The AI Act adds its own transparency, logging, human oversight, and risk-monitoring requirements. The practical challenge is not choosing between frameworks but building a single compliance architecture that satisfies both, without duplicating effort or creating documentation that contradicts itself.


Three regulatory forces converge in this article:

  • GDPR Article 35: mandatory Data Protection Impact Assessment (DPIA) before deploying any high-risk processing system.

  • EU AI Act Article 27: Fundamental Rights Impact Assessment (FRIA) for deployers of high-risk AI systems, a new, broader obligation that overlaps substantially with the DPIA.

  • EU AI Act Article 26: proactive transparency and consultation obligation toward employee representatives before deployment, distinct from, and in addition to, GDPR privacy notices.


For any AI monitoring tool classified as high-risk under the EU AI Act, GDPR compliance is not optional, it is legally embedded within the AI Act itself. Article 26 of the AI Act explicitly cross-references GDPR Article 35, making the DPIA a mandatory prerequisite for deploying high-risk AI that processes personal data. Organizations that treat these as separate workstreams will face both duplication of effort and compliance gaps at the seams.


This article, the second in a three-part series, maps the exact intersection points between GDPR and the AI Act for HR monitoring tools, and provides a unified documentation approach that satisfies both simultaneously.


1. The Compliance Overlap Problem(GDPR AI Act HR compliance)

The EU AI Act does not replace GDPR. Article 2 of the AI Act explicitly states that it is without prejudice to GDPR. In practice, employers deploying AI monitoring tools face obligations from both instruments simultaneously and must ensure that compliance with one does not create violations of the other.

Three structural overlaps create the core challenge:

  • The DPIA/FRIA overlap: GDPR Article 35 requires a Data Protection Impact Assessment before any high-risk data processing. The AI Act introduces an analogous Fundamental Rights Impact Assessment (FRIA) for high-risk AI deployers under Article 27. Both assessments involve mapping potential harms to affected individuals — making an integrated approach both logical and efficient.

  • The transparency double layer: GDPR Articles 13 and 14 require organizations to provide employees with privacy notices. The AI Act Article 26 requires employers to inform and consult employee representatives before deploying high-risk AI. Both obligations must be met, but they differ in timing, audience, and content.

  • The lawful basis/purpose limitation tension: GDPR requires a lawful basis for processing and limits it to specified purposes. The AI Act’s input data quality obligations require employers to ensure data used by AI is relevant and representative. Using historical performance data to train an AI that then allocates tasks could violate GDPR purpose limitation if the data was originally collected for a different purpose.


2. GDPR Article 35 — Mandatory DPIAs for AI Monitoring Tools


A. When Is a DPIA Mandatory?

A Data Protection Impact Assessment is mandatory under GDPR Article 35 before commencing any processing “likely to result in a high risk to the rights and freedoms of natural persons.” For AI monitoring tools, this threshold is almost always met. Three criteria in Article 35 directly apply:

  • Systematic monitoring of employees: Article 35(c) explicitly references systematic monitoring in a publicly accessible area, and supervisory authorities have extended this to workplace monitoring of all kinds.

  • Processing of special categories of data: Article 35(b), health data, biometric data, data about trade union membership are all potentially implicated by AI monitoring tools.

  • Automated decision-making with significant effects: Article 35(a), any AI-generated performance score, task allocation decision, or attrition-risk flag that influences employment decisions triggers this criterion.


Practical rule: If an AI system touches any of the following, a DPIA is mandatory: performance scores, productivity metrics, attendance patterns, communication analysis, task allocation, or anything linked to promotion, termination, or pay decisions.


B. What a DPIA Must Contain for AI Monitoring Systems

Under GDPR Article 35, a DPIA must include at minimum the following, each of which carries specific implications for AI monitoring tools:

Describe the AI system, its logic, data inputs, and outputs. “Productivity tracking software” is insufficient, the description must be specific enough to enable a genuine risk assessment.

Necessity and proportionality

Why is AI monitoring necessary? Could less intrusive methods achieve the same business purpose? Is the scope of monitoring proportionate to the objective?

Risks to rights and freedoms

Identify specific risks: discrimination from biased algorithms, disproportionate surveillance, unjustified performance penalties, chilling effects on employee behaviour.

Measures to address risks

Technical and organisational controls: encryption, access restrictions, anonymisation, human review before consequential decisions, bias testing, audit trails.

DPO consultation

The Data Protection Officer must be consulted under Article 35. In Germany, BetrVG 167/90 also requires the works council to be informed of planned technical monitoring systems.


C. The AI Act’s Parallel Assessment: The Fundamental Rights Impact Assessment

The EU AI Act introduces a separate, but conceptually related, assessment obligation for deployers of high-risk AI systems.

The Fundamental Rights Impact Assessment (FRIA) under Article 27, which became enforceable from August 2026.


The FRIA has a broader scope than the DPIA:

  • It covers not just data protection rights, but all fundamental rights under the EU Charter: dignity, non-discrimination, privacy, freedom of association, fair working conditions, and more.

  • It requires the deployer to describe the context of AI use, the specific population affected (e.g., all employees in a German subsidiary), the foreseeable impacts on fundamental rights, and the mitigating measures taken.

  • The European Commission is developing a standard template for the FRIA; deployers must use it once published.


D. Integrating DPIA and FRIA: The Practical Approach

Despite covering different legal ground, the DPIA and FRIA share substantial overlapping content. Conducting them as a single integrated exercise, with a unified document that satisfies both, is not only possible but is recommended by the European Data Protection Board and the EU AI Office.

3. Lawful Basis for Employee Monitoring Under GDPR


A. Why Employee Consent Is Almost Never Valid


Consent under GDPR Article 6(a) requires that it be freely given, specific, informed, and unambiguous. In an employment relationship, consent is rarely “freely given” because of the inherent power imbalance between employer and employee. An employee is not in a position to refuse consent without risking adverse consequences.

The European Data Protection Board and most national supervisory authorities, including the German Datenschutzkonferenz (DSK), have consistently held that employee consent is valid only in exceptional circumstances where there is no detriment if the employee declines, and the employee can withdraw at any time without consequences. These conditions are virtually impossible to satisfy for systematic AI monitoring that applies to all employees.


Conclusion: Do not rely on consent as the lawful basis for AI monitoring tools.


B. Legitimate Interest: Available but Constrained

Legitimate interest under Article 6(f) is theoretically available but carries significant risks in the employment context. A three-part balancing test applies

  • Is there a legitimate interest? Productivity monitoring, fraud detection, IT security, and performance management generally qualify.

  • Is the processing necessary? The AI system must be the least intrusive means of achieving the legitimate aim. An AI that monitors every keystroke may not survive this test if simpler output-based measurement would suffice.

  • Do the interests of the employees override? Courts and supervisory authorities have increasingly found that systematic AI-driven monitoring creates disproportionate infringements on employee privacy, even when the employer has a legitimate interest.


In Germany: BDSG 167/26 provides the primary legal basis for employee data processing, and it is narrower than legitimate interest. Processing must be objectively necessary for the employment relationship, not merely useful or convenient. See Part 3 of this series for detailed analysis.


C. Legal Obligation: Narrow but Reliable

Processing required by law under Article 6(c) provides a solid, challenge-resistant basis. For specific monitoring, particularly working time recording mandated by the ECJ’s Deutsche Bank case and national implementations, legal obligation can serve as the basis. However, this is a narrow foundation that cannot be stretched to cover general performance monitoring or AI analytics.


D. The Special Category Data Problem

Many AI monitoring tools inadvertently process special category data under Article 9 GDPR, which carries significantly higher legal thresholds. Several practical scenarios arise:

  • Health inference: AI systems that flag unusual attendance patterns, keyboarding irregularities, or response time changes may effectively infer health conditions, constituting special category processing without the employer realising it.

  • Trade union activity inference: Communication analysis tools that map collaboration networks could reveal trade union membership or organising activities.

  • Biometric data: Productivity tracking through typing patterns, mouse movement analysis, or facial recognition for attendance constitutes biometric data processing.


For special category data, legitimate interest is not a valid lawful basis. Processing requires either explicit consent (not viable in employment as discussed) or an explicit legal exception under Article 9. In Germany, BDSG 167/26 provides some narrow exceptions for employment contexts, but these require strict necessity and careful documentation.


4. The Transparency Double Layer: GDPR + AI Act


A. GDPR Articles 13/14: Privacy Notices for AI Processing


Under GDPR, employees must receive clear privacy notices explaining what data the AI system collects, the purposes and legal basis for processing, data retention periods, and critically whether automated decision-making is involved. The Article 22 notice is particularly important.

Where AI outputs are used to make decisions that significantly affect employees, employees have the right to an explanation of the logic involved, a right to human review of the decision, and a right to contest the decision.


B. AI Act Articles 13/26: Worker Notice Before Deployment

The AI Act adds a separate, proactive notification obligation. Article 26 requires employers, as deployers of high-risk AI systems, to inform and consult employee representatives before deploying such systems. This obligation is distinct from individual GDPR privacy notices in three ways

  • Audience: The AI Act notice is directed at employee representatives (Betriebsrat in Germany, equivalent bodies elsewhere), not just individual employees.

  • Timing: Notice must be given before deployment, not at the point of data collection.

  • Content: The notice must explain the purpose, characteristics, and effects of the AI system, effectively explaining the system’s logic in plain terms accessible to non-technical representatives.


C. Building a Single Disclosure Architecture

The dual notification regime can be rationalised into a coherent disclosure architecture, with a single employee-facing communication supplemented by a separate works council consultation process:

5. A Unified Compliance Documentation Framework

Rather than maintaining four separate documentation systems, each with its own update cycle and ownership, employers can build a unified “AI Compliance File” for each high-risk AI system. This file consolidates four integrated layers into a single source of truth, auditable by supervisory authorities, works councils, and the EU AI Office.

Maintaining the File: Review the integrated DPIA/FRIA at least annually, or after any significant change to the AI system or its deployment context. Update the RoPA entry whenever the scope of processing changes. Retain system logs for at least six months (AI Act minimum) and longer where applicable limitation periods require it.
