Executive Summary

The year of 2026 marks a regulatory inflection point for any organization using AI-driven tools to track productivity, evaluate performance, or manage its workforce in the European Union. Three regulatory forces are converging simultaneously:

  • EU AI Act (Regulation (EU) 2024/1689): High-risk AI obligations for employment-related systems become enforceable from August 2026.

  • GDPR: Existing data protection rules impose strict limits on employee monitoring, requiring proportionality, transparency, and Data Protection Impact Assessments (DPIAs).

  • German national law: The Betriebsverfassungsgesetz (BetrVG) grants works councils’ co-determination rights over technical monitoring systems, while the evolving Beschäftigtendatengesetz (Employee Data Act) signals stricter rules ahead.

Employers who deploy these systems without meeting strict compliance obligations face fines of up to €35 million or 7% of global annual turnover. More critically, organizations operating in Germany must navigate these requirements alongside works council co-determination rights — making unilateral deployment of “black-box” monitoring tools legally and practically untenable.


This article — the first in a three-part series — maps the regulatory landscape that HR leaders must understand before deploying or continuing to use AI-driven monitoring and performance management tools in the EU.


1. Why AI in Workforce Monitoring Is Now a Board-Level Compliance Issue


The adoption of AI in human resources has accelerated dramatically. According to recent estimates, over 70% of European companies now use AI in at least one HR function, spanning recruitment screening, performance analytics, productivity tracking, and employee sentiment analysis. What was once a technology decision has become a regulatory and governance challenge.


The EU AI Act(the world’s first comprehensive legal framework for artificial intelligence)does not treat all AI systems equally.

  • It uses a risk-based classification model: from minimal risk (largely unregulated) to unacceptable risk(banned). In between sits the high-risk category, which carries the heaviest compliance obligations. Critically for HR, employment, workers’ management, and access to self-employment are one of the explicitly listed high-risk domains under Annex III of the Act.


This means that the productivity dashboards, attendance prediction algorithms, performance scoring engines, and workforce analytics platforms increasingly common in modern HR departments are not peripheral to the regulation. They are at its core.


2. What the EU AI Act Says About Employee Monitoring and Performance Evaluation


A. Annex III: The High-Risk Classification

Article 6(2) and Annex III of the AI Act define two categories of employment-related high-risk AI systems:

Category 4(b) is particularly significant for this series

  • It covers the full spectrum of AI-driven monitoring and performance management tools. Any AI system that tracks employee behavior, evaluates performance metrics, allocates tasks based on personal characteristics, or monitors workforce patterns falls squarely within this classification.

Profile individuals

  • Furthermore, the AI Act specifies that AI systems which profile individuals(defined as automated processing of personal data to assess aspects of a person’s life such as work performance, economic situation, reliability, behavior, or movement) are always classified as high-risk, without exception.


B. The Emotion Recognition Ban: Already in Force

As of 2 February 2025, the AI Act’s provisions on prohibited AI practices are already enforceable. Article 5 bans several AI applications outright, including:

  • Emotion recognition systems in the workplace: AI tools that infer employees’ emotional states from biometric data(facial expressions, voice patterns, physiological signals) are now prohibited in workplace and educational settings.

  • Social scoring: AI systems that evaluate or classify individuals based on social behavior or personal characteristics in ways that lead to detrimental treatment.

  • Manipulative AI: Systems deploying subliminal techniques or exploiting vulnerabilities to materially distort behavior.


Practical implication: If your organization uses any tool that claims to assess employee “engagement,” “mood,” or “sentiment” through facial analysis, voice tonality, or biometric indicators, this functionality is now illegal in the EU. HR teams must audit existing tools immediately to confirm no such features are active — even as optional modules within broader platforms.


C. High-Risk System Obligations: What Employers Must Do by August 2026


From 2nd August 2026, all high-risk AI systems must comply with the full set of requirements under the AI Act. For employers deploying AI monitoring or performance tools (classified as “deployers” under the Act), the core obligations include:

Trained personnel must be able to understand, monitor, interpret, and override AI-driven decisions. AI outputs in performance reviews or task allocation cannot be implemented as final decisions without human review.

Transparency & Worker Notice

(Art. 13, 26(7))

Employees and their representatives must be informed before AI systems affecting them are deployed. This includes explaining the purpose, logic, and potential impact of the tool. Information must be clear, accessible, and provided proactively.

Logging & Record-Keeping

(Art. 12, 26)

AI systems must automatically generate logs of their operations. Employers must retain these logs for at least six months. This creates an auditable trail of every AI-driven monitoring decision.

Monitoring for Risks

(Art. 26)

Deployers must continuously monitor AI system operation and promptly suspend use if adverse impacts (e.g., discrimination, privacy violations) are detected. Serious incidents must be reported.

DPIA Requirement

(Art. 26(9))

Before deploying a high-risk AI system that processes personal data, employers must conduct a Data Protection Impact Assessment under GDPR Article 35. This is mandatory, not optional.

Input Data Quality

(Art. 26)

Employers must ensure that the data fed into AI systems is relevant and sufficiently representative. Feeding biased historical performance data into monitoring AI could constitute a compliance violation.


D. Provider vs. Deployer: Understanding Your Role

The AI Act distinguishes between providers(who develop and market AI systems) and deployers(who use them in their operations). Most employers are deployers. However, this distinction carries a critical nuance:

  • Providers bear the primary burden: conformity assessment, CE marking, registration in the EU AI database, technical documentation, and quality management systems.

  • Deployers are responsible for operational compliance: following provider instructions, ensuring representative input data, assigning human oversight, monitoring for risks, retaining logs, reporting incidents, and informing affected workers.

  • Critical warning: If an employer significantly modifies or fine-tunes an AI system (e.g., customising a vendor’s performance scoring model), they may be reclassified as a provider, triggering the full, more onerous set of obligations.


Employers cannot outsource compliance by relying solely on vendor assurances. The Act establishes a shared responsibility model: even if the vendor (provider) has completed its conformity assessment, the employer (deployer) remains independently liable for how the system is used in practice.


3. The Expanding EU Regulatory Landscape: Beyond the AI Act


A. European Parliament’s November 2025 Initiative on AI in the Workplace


In November 2025, the European Parliament advanced a call for the European Commission to launch a dedicated legislative initiative regulating AI in the workplace. While still in its early stages, this proposal signals a clear trajectory toward even stricter rules. Three aspects stand out:

  • Mandatory human oversight: AI-driven decisions in recruitment, performance evaluation, and workforce management must be monitored by humans, with ultimate accountability remaining with human managers.

  • Reinforced data protection compliance: The proposal reaffirms GDPR obligations within AI systems, emphasizing lawful, transparent, and purpose-limited processing of employee data.

  • Employee information rights: Workers must be informed when AI is used in processes affecting them, including the purpose, logic, and potential impact of the system, empowering them to understand and challenge decisions.


Strategic implication: Even if the Digital Omnibus package delays certain AI Act deadlines, the regulatory direction is unmistakable: AI in the workplace will not remain a black box. To ensure legal transparency and effective human oversight, workplace AI must operate as an explainable system with clear accountability. Organizations that invest in transparency and governance now will be ahead of the curve, regardless of specific implementation dates.


B. The Digital Omnibus Package: Potential Timeline Shifts


In November 2025, the European Commission presented its Digital Omnibus package, which proposes amendments to the AI Act. The most relevant element for HR departments is a potential adjustment to the high-risk system compliance timeline, rather than a fixed August 2026 deadline, the entry into force may be made conditional on the availability of harmonized technical standards, with fallback deadlines of December 2027(under discussion) or August 2028.


However, three critical points remain unchanged:

  • The Omnibus package remains a proposal subject to the trilogue process (EU Council and European Parliament) and is not yet adopted.

  • Article 26(7) of the AI Act already requires employers to inform and consult employee representative bodies before deploying high-risk AI systems, regardless of any timeline postponement.

  • The prohibition on emotion recognition in the workplace (Article 5) has been in force since February 2025 and is unaffected.


PEOPLEGRIP Insight: Companies must continue to prepare for a potential enforcement date as early as August 2026. Treating a possible delay as a reason to postpone preparation would be a strategic error. Compliance documentation, bias testing, human oversight design, and works council consultation all require significant lead time.


C. The AI Act Whistleblower Tool


In November 2025, the EU AI Office launched a dedicated AI Act Whistleblower Tool, enabling employees, contractors, and external stakeholders to anonymously report breaches of the AI Act in the workplace. This introduces a new enforcement vector: non-compliance can now be flagged directly by the workforce, not only by regulators. For HR departments, this significantly raises the stakes of deploying AI tools without proper governance and employee communication.


4. Common AI Monitoring Tools Under Regulatory Scrutiny


To make the regulatory framework practical, it is essential to understand which tools commonly used in HR are likely to fall within the high-risk classification. The following table maps common AI-driven HR tools against their regulatory exposure:
